No, this is not possible.

Is there a risk of facing (criminal) legal consequences due to my gambling activity with casino providers illegal in Austria?

This is not to be expected. Current jurisprudence in Austria exclusively states that the offering of online casino games without an Austrian license is prohibited and can consequently entail legal consequences.

What do I need to participate in the collective action?

Nothing! You register with us, and we will guide you through the entire process.

What happens to the winnings that I have received?

The collective action aims to reclaim your deposited amounts, reduced by any payouts (winnings) received.

However, if a net profit was made at a casino (payouts > deposits), then proceeding within our collective action is not possible.

What is the minimum amount of damages required to participate in the collective action?

Participation is possible with a net gambling loss (deposits – payouts) of EUR 1,000 (with one provider). Payments from January 1, 2000 can be considered within the scope of the collective action. Payments made before this period cannot currently be included.

Will I incur costs in the context of litigation funding?

NO! Participation in our collective action is free of charge and risk-free for you! AdvoFin finances the costs of the procedure (both in and out of court) and, in case of success, receives a share of the proceeds as compensation.

In the event of a loss, AdvoFin naturally bears all costs.

What is AdvoFin's share in the event of success?

In case of success, for assuming the litigation risk and financing all costs, we receive a participation rate of 37% of the litigation proceeds. In the event of an out-of-court settlement (before filing a lawsuit), the participation rate is reduced to just 19%.

Is a review of my potential claims possible free of charge?

Certainly. Following your online registration on our website and the upload of the required documents, AdvoFin’s team will review your claims free of charge and discuss the next steps directly with you.

How long does the enforcement of my claims typically take?

This varies greatly from case to case and depends on the complexity of the case as well as the opposing party’s willingness to resolve it. AdvoFin would be unprofessional to make a blanket statement.

Does AdvoFin file suit in my name or its own?

AdvoFin does not file lawsuits itself. Any potential lawsuit will be conducted by the lawyer you commission on your behalf.
