In July 2016 the European Commission has identified an EEA-wide truck cartel, in which MAN, Volvo/Renault, Daimler, Iveco Scandia and DAF have participated and have violated the European competition rules.
About the case
For 14 years (1997 – 2011) the gross list prices for trucks have been agreed upon illegally by 6 European truck producers. AdvoFin has started a class action suit in the spring of 2019, in order to enable victims of this cartel to claim their damages.
You and your company are elidable to claim damages on the basis of the illegal cartel, if you purchased/leased/rented medium-weight (6-16 tons) or heavy trucks (16 tons and above) in the EEA between 2004 and 2011.
The amount of the damage claims cannot be determined exactly as of now. This will be done as part of the litigation process via expert´s reports. First estimates have found the cartel surcharges to be as high as 10 %. This means the potential damage claim per truck is expected to be 5.000 EUR and more.
As a litigation financing company, AdvoFin only receives 34 % of the claim in the case of a successful litigation as a compensation for financing the litigation process and all costs associated with it. If the case is not successful, AdvoFin covers all the occurred costs.
