We are proud of 25 years of AdvoFin and over €380 million that we have recovered for our more than 90,000 clients to date.
For weeks and months, it has been regularly reported in the media that online gambling providers have been ordered to repay lost funds to Austrian customers. Over 5,000 AdvoFin clients alone have already recovered their losses.
But how is this possible? These are well-known providers with names like Mr. Green, Bwin, or Pokerstars, and furthermore, they continuously advertise in Austria.
The reason is simple: Offering online gambling in Austria is not permitted without an Austrian license.
In Austria, gambling is regulated by the so-called Gambling Act (GSpG). Online casinos offer games of chance as per § 1 GSpG (Roulette, Poker, Blackjack, Slots, Two Aces, Bingo, Craps, Keno, Baccarat, etc.).
The Gambling Act stipulates that only the federal government is authorized to operate such gambling activities, due to the high addictive potential of gambling offerings. However, the federal government is simultaneously permitted to transfer this right to others through a license.
This is the case in Austria: Casino Austria AG, with its platform win2day, holds the sole Austrian license that permits online gambling to be offered in Austria.
The licensing system ensures that licensees adhere to Austrian regulations for offering gambling – this is also regularly reviewed by the authorities.
All other companies that make their gambling offerings available via the internet in Austria (Mr. Green, Pokerstars, Interwetten, bwin, Bet-At-Home, NetBet, Wunderino, William Hill, bet365, Lapalingo, Tipico, … to name just a few of the countless names) only possess foreign licenses from countries such as Malta or Curacao. These are not valid or relevant in Austria according to the current legal situation and jurisprudence.
Consequently, the offerings of these gambling providers to Austrian customers are illegal and unlawful – the gambling contract concluded by the customer is therefore void!
Online gambling providers argue that the Austrian Gambling Act violates EU law – specifically the freedom to provide services. The European Court of Justice has repeatedly rejected this argument (e.g., ECJ C-347/09). In Austria, the Supreme Court, the Administrative Court, and the Constitutional Court (thus all courts of last resort!) have also confirmed that the Austrian Gambling Act is in compliance with EU law.
We are proud of 25 years of AdvoFin and over €380 million that we have recovered for our more than 90,000 clients to date.
The losses can be recovered through civil legal action in Austrian courts! This means that the gambling provider is sued for the repayment of losses.
As such lawsuits involve enormous costs (attorney, court fees, translation costs, potential enforcement…), engaging a litigation financier like AdvoFin is a sound decision for most clients.
As the litigation funder for your case, AdvoFin finances all incurred costs (even if a case is unexpectedly lost) and only receives a share of the enforced reclamation in case of success.
AdvoFin can draw on experience from over 10,000 financed cases in the recovery of online gambling losses in Austria and Germany. As a market leader among litigation financiers with a 21-year history, it is a reliable partner for clients.
Interested parties can register with AdvoFin here without obligation within 5 minutes. After registration, AdvoFin, together with the appointed lawyers, will handle the entire process.
The lawsuit itself is filed in Austria (at the local district or regional court). The respective gambling provider, which is based abroad (primarily Malta), is sued. The duration of the proceedings is typically between 12 and 18 months. So far, no AdvoFin-financed case has been lost! In total, over €75 million in losses have already been recovered. Important: Only the net loss is recovered (deposits minus withdrawals). Sports betting losses or losses incurred during a stay abroad cannot be recovered.
